Electronic Monitoring - GPS Violations and Responses Matrix

In order to address the unique issues associated with problem behaviors in moderate to high risk juveniles placed on Home Detention, and who also must conduct themselves appropriately in the community while on official probation, or under pre-dispositional release conditions, the following violations and responses matrix is used to assist in case disposition. The violations/responses flow chart is given to the program participant and his/her parents at orientation. We believe this provides the juvenile with solid proof of what they can expect for not adhering to expectations. The flow chart is easy to follow and understand but is still explained in detail to the juvenile and parent at orientation, or as needed.

Level 1 Violations/Responses:

Responses to Level 1 Violations will address behaviors that do not present immediate safety concerns for the community but, if left unchecked, may increase the juvenile’s risk to re-offend over time.

Level 2 Violations/Responses:

Responses to Level 2 Violations are designed, in part, to address repeat level 1 violations that were previously addressed by staff, yet the participant has not begun to comply with our expectations. Level 2 Violations also include acts that are seen to be more serious (presenting higher risk) or may endanger the juvenile. Whenever possible, responses are discussed with parents to get their input and solutions.

Level 3 Violations/Responses:

Responses to Level 3 Violations are targeting continual, repeat, antisocial / maladaptive behavior, dangerous or threatening behavior, or criminal delinquent activity. The focus becomes community safety so the juvenile is returned to court for a status or modification hearing. At those hearings the court will decide if the juvenile is to be detained for their own protection or that of the community.

Incentives:

Juvenile Community Corrections believes it is important to recognize and reward the positive achievements of those placed on Home Detention. Upon completing the first two weeks of Home Detention, the program participant becomes eligible for Recreational Passes. Four-hour Recreational Passes are given when a program participant goes a week without any Level 1 violations. If they have one Level 1 violation then they will receive only a two-hour pass. Program participants become ineligible for Recreational Passes for any Level 2 or Level 3 violations for a minimum of 1 week.

Those program participants who are placed on Home Detention for an open-ended period of time, who demonstrate good behavior, will be evaluated for possible placement on Trust House Arrest. That process is further explained in the Home Detention Handbook.

Level 3
  • 4th instance of any Level 1 violation
  • 2nd instance of marijuana or alcohol use
  • 1st instance of school suspension based on criminal delinquent act
  • 2nd instance (or more) of school suspension
  • 2nd instance (or more) of Level 2 location violation
  • 1st instance of school expulsion (excludes pending)
  • New delinquent act (new offense)
  • Weapon Violations
  • Absconding/Escape
  • 1st instance of use of a controlled substance other than marijuana or alcohol
  • Mandatory court action
  • Placement in detention
  • Permanent loss of Recreational Passes (if not detained)
  • Evaluate need to remove from program and place in correctional facility or residential placement.
